ValueXPA terms of service governing use of our website, downloadable publications, screener tools, and the Margin Drift Diagnostic engagement model.
These Terms of Service govern your use of valuexpa.com (the Website), any mobile applications made available from time to time (collectively, the Platform), all downloadable publications and lead magnets distributed through the Platform, the Margin Drift Screener tool, the FynFlo product surfaces accessed through the Platform, and any client engagement entered into through this Website with FinnAcer Technologies LLP operating under the ValueXPA brand (We, Us, Our). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to any of these Terms, do not use the Platform. Engagement-specific terms in a signed Statement of Work supersede these general Terms where they conflict on subject matter expressly covered by the Statement of Work.
You must be at least 18 years of age and capable of forming a binding contract under applicable law to use the Platform. If you are using the Platform on behalf of a company or other entity, you represent that you have the authority to bind that entity to these Terms. You are responsible for maintaining the confidentiality of any login credentials issued to you for accessing client deliverables, dashboards, or the FynFlo product. You agree to notify us immediately at info at valuexpa dot com of any unauthorised use of your credentials or any other suspected breach of security on your account. We are not liable for any loss arising from unauthorised use of your account where you have failed to maintain credential confidentiality.
All content on the Platform — including the Margin Drift Diagnostic methodology, published insights articles, case studies, publications, the Margin Drift Screener tool logic, dashboards, copy, graphics, logos, button icons, images, and software — is the property of FinnAcer Technologies LLP or its licensors and is protected by applicable Indian and international intellectual property laws. You may view and print individual pages for non-commercial personal use and you may share linked references to insights articles and case studies through standard hyperlinking. You may not reproduce, modify, distribute, scrape, train AI models on, or create derivative works from any content on the Platform without our prior written consent. Permission requests should be directed to info at valuexpa dot com.
Publications and lead magnets distributed through the Platform (including the Margin Drift Practitioner Study, the 14-Point Margin Drift Checklist, and any future PDF deliverables) are provided for informational purposes only. Download access is granted after you provide your email address through the publication form. Submission constitutes consent for us to email you the publication and follow-up content relevant to the publication topic. You may unsubscribe at any time using the unsubscribe link in any commercial email. Publications may not be redistributed externally, repackaged, or used in any commercial training data set without our prior written consent. Quoting or citing publications in articles, presentations, or research with proper attribution to ValueXPA is permitted.
The Margin Drift Screener and other interactive tools provided through the Platform produce directional estimates calibrated against engagement benchmarks from prior client work. These estimates are not financial, legal, or audit advice and are not a substitute for professional consultation. Outputs are deliberately conservative; actual recoverable amounts in a full Margin Drift Diagnostic engagement may be higher or lower than screener outputs. You acknowledge that no contractual entitlement to any specific dollar outcome arises from screener use, and you indemnify us against any decisions you take based solely on tool outputs without engaging us for a full diagnostic.
Where you engage us for a Margin Drift Diagnostic, Finance Processes Managed Services, Extended Planning and Analytics build, Advanced Analytics and Business Intelligence implementation, or any other professional service, the specific terms in the signed Statement of Work (including scope, pricing, payment terms, deliverables, intellectual-property allocation, confidentiality, indemnities, and liability caps) supersede these general Website Terms with respect to that engagement. Where the Statement of Work is silent on a matter, these Terms govern. Engagement deliverables are subject to the warranty and remedy provisions in the Statement of Work; the general Terms here do not extend any warranty to engagement deliverables.
The Platform and all content, tools, and publications are provided on an as-is and as-available basis without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, revenues, data, or opportunity — arising from or relating to your use of the Platform, tools, or publications, even if advised of the possibility of such damages. Our aggregate liability for all claims arising from your use of the Platform (excluding professional engagement liabilities, which are governed by the relevant Statement of Work) shall not exceed Indian Rupees 10,000 or the equivalent in your local currency.
These Terms are governed by the laws of India. Any dispute arising from or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the competent courts in Chennai, Tamil Nadu, India. We reserve the right to change, modify, add to, or delete portions of these Terms at our sole discretion at any time. Material changes will be notified through a banner on the Platform or via email to registered users for at least 30 days before they take effect. Continued use of the Platform after the effective date of any change constitutes acceptance of the revised Terms.
